The twinning Project Appui à la réforme de la justice administrative en Tunisie TN 15 ENI JH 05 18 is financed by the European Union’s ENI fund and the total budget is € 1.000.000. The twinning partners are the Tribunal administratif de Tunisie as the Beneficiary, the Italian Consiglio di Stato as Lead Partner and Eutalia as Mandated Body.
The Project objective is to support the implementation of the tunisian administrative justice reform according to a efficiency driven approach, decentralization and jurisdiction effectiveness. The project is also part of a broader reform, which has already influenced the administrative judiciary sector in accordance with the Tunisian Constitution of 2014.
The effectiveness of decentralized administrative justice is a prerequisite for a well performing democracy and the protection of the subjective positions of citizens in the action of the public administration. In this regard, the Twinning Project will pay particular attention to judicial review of local electoral procedures and judicial measures to implement court decisions in the case of administrations which are not properly alligned.
The Project duration is 30 months and they will be achieved through several activities divided in 4 main components:
- A – LEGAL FRAMEWORK
Proposals for the establishment of a new legal framework adapted to the new Tunisian constitution are elaborated
- B – ORGANIZATION OF ADMINISTRATIVE JUSTICE
Launch of an organization of administrative justice adapted to the new reform
- C – CAPACITY BUILDING
The skills of the Administrative Courts will be improved for the implementation of the reform, using a methodological framework
- D – INSTITUTIONAL COMMUNICATION
The administrative justice will be open to its external environment through:
- communication strategy and ad hoc plan
- simplified guides for public and private law
